PACE66 Terms of Use

These Terms of Use (“Terms”) govern your access to and use of PACE66, including the PACE66 website, applications, features, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The PACE66 Service

PACE66 provides tools for setting fitness goals, tracking progress, reviewing activity and performance information, manually recording activities, connecting supported third-party fitness services, and discovering activities or events that may help users pursue their goals. Features may change, be added, removed, or remain experimental, particularly while PACE66 is in beta.

2. Eligibility and Accounts

You must be legally capable of agreeing to these Terms and meet any minimum age required by applicable law to use the Service. PACE66 may limit registration or access during private or limited beta periods.

You are responsible for maintaining the security of your account and for activity occurring through your account. You must provide accurate information when required and must not use another person's account without authorization.

3. Fitness and Health Disclaimer

PACE66 is a fitness information, goal-tracking, and activity-planning service. It is not a medical service and does not provide medical diagnosis, treatment, or professional medical advice. Activity statistics, performance information, goals, recommendations, scores, estimates, and other information provided through the Service are informational only.

Physical activity involves risk. You are responsible for deciding whether an activity, training plan, event, route, goal, or recommendation is appropriate for you. Consider your health, fitness, experience, weather, terrain, traffic, equipment, and other conditions, and consult an appropriate healthcare professional when necessary.

4. Connected Services and Imported Data

PACE66 may allow you to connect third-party services such as fitness or activity platforms. If you connect a service, you authorize PACE66 to receive and process information made available through that connection in accordance with your authorization and our Privacy Policy.

Third-party services are governed by their own terms and privacy practices. PACE66 does not control and is not responsible for the availability, accuracy, security, policies, or operation of third-party services. You may disconnect supported integrations using available account controls or through the applicable third-party service.

5. Manual Activity Information

You may be able to enter activity information manually. You are responsible for the accuracy and lawfulness of information you submit. PACE66 may use manually entered activities together with imported activities to calculate goals, progress, performance statistics, and other features.

6. Goals, Performance, and Calculations

PACE66 calculations and analytics may depend on information supplied by you or third parties and may contain inaccuracies, omissions, delays, or differences from calculations made by another service or device. Metrics, averages, goal progress, performance information, and similar outputs should not be treated as guaranteed or professionally validated measurements.

7. Events and Ways to Reach Your Goals

PACE66 may discover, aggregate, rank, or recommend third-party events and activities based on factors such as location, activity type, dates, and your goals. Event information may originate from public websites, event organizers, registration providers, search services, or other third parties.

PACE66 does not organize or operate third-party events unless expressly stated otherwise. Event dates, locations, distances, routes, availability, pricing, eligibility requirements, safety conditions, and other details may be inaccurate, incomplete, or change without notice. Always verify important information directly with the event organizer or official registration source before relying on it, registering, traveling, or participating.

8. Location Information

Certain features may use a location you provide or confirm, or an approximate location inferred from activity information, to identify nearby events or provide location-related features. You are responsible for reviewing and correcting location information when the Service provides that ability.

9. Feedback and Screenshots

If you submit feedback, suggestions, bug reports, or screenshots, you authorize PACE66 to use that material to operate, troubleshoot, secure, evaluate, and improve the Service. You retain ownership of content you submit. You grant PACE66 a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze submitted feedback and screenshots for these purposes.

Do not include information in screenshots or feedback that you do not want PACE66 to receive.

10. Acceptable Use

You agree not to misuse the Service. You may not attempt to gain unauthorized access to accounts, systems, APIs, or data; interfere with operation of the Service; introduce malicious code; scrape or automate access in a manner that materially burdens the Service; impersonate another person; submit unlawful content; or use the Service in violation of applicable law.

11. Intellectual Property

PACE66 and its software, branding, designs, interfaces, and original content are owned by PACE66 or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purposes. They do not transfer ownership of PACE66 intellectual property to you.

Names, trademarks, data, and content belonging to third parties remain the property of their respective owners.

12. Beta Features

Some or all of the Service may be offered as a beta, preview, or experimental service. Beta features may be incomplete, change substantially, experience interruptions, contain errors, or be discontinued. You should not rely on beta features for critical purposes.

13. Availability and Changes

PACE66 may modify, suspend, restrict, or discontinue any part of the Service. We do not guarantee that the Service or any particular feature will always be available, error-free, secure, or compatible with every device or third-party service.

14. Suspension and Termination

PACE66 may suspend or terminate access when reasonably necessary to protect the Service, users, third parties, or PACE66, including for violations of these Terms or misuse of the Service. You may stop using PACE66 at any time. Account and data deletion requests will be handled as described in the Privacy Policy and available account controls.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” PACE66 disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. PACE66 does not warrant the accuracy or completeness of activity data, event information, recommendations, calculations, third-party data, or other Service content.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, PACE66 and its owners, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from or related to the Service.

PACE66 is not responsible for injuries, losses, or damages resulting from participation in physical activities or third-party events, except to the extent liability cannot legally be excluded or limited.

17. Third-Party Links and Services

The Service may contain links to third-party websites, event registration pages, applications, or services. Links are provided for convenience and do not imply endorsement. Your interactions with third parties are between you and the applicable third party.

18. Changes to These Terms

We may update these Terms as the Service evolves or as legal or operational requirements change. We will update the effective date when we make changes. Where appropriate, we may require users to review and accept updated Terms before continuing to use the Service.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
